John Norman & Richard Norman To William Norman
Release

South Carolina. This indenture made the Twenty third day of September in the Year of our Lord One thousand Seven hundred and Sixty Eight [23 Sep 1768] and in the Eighth Year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the faith and so forth. Between John Norman and Richard Norman of Charles Town in the province aforesaid of the one part and William Norman of Beach Hill in Saint Pauls Parish in the said province Planter of the other part

Witnesseth that for and in consideration of the sum of One thousand One hundred and thirty Seven pounds fifteen shillings [£1137-15s] Lawfull Current money of the province aforesaid to the said John Norman and Richard Norman or one of them by the said William Norman in hand well and truly paid at and before the Sealing and Delivery of these presents the Receipt whereof the said John Norman and Richard Norman Do hereby acknowledge and thereof and of and from every part and parcel thereof Acquit Release and Discharge the said William Norman his heirs Executors Administrators and Assigns They the said John Norman and Richard Norman have Granted Bargained Sold Aliened Promised Released and Confirmed and by these presents do fully and absolutely Grant Bargain Sell Alien Promise Release Convey and Confirm unto the said William Norman in his actual Possession now being by Virtue of a Bargain and Sale to him thereof made by the said John Norman and Richard Norman for one whole Year by Indenture bearing date the day next before the day of the date of these presents and of the Statute for transferring of uses into in Possession made of force in this province and to his heirs and assigns for ever [sic] All that Plantation or tract of Land of them the said John Norman and Richard Norman Five hundred and Fifty five [555] acres Situate Lying and being at Beach Hill in St. Pauls Parish in Colleton County in the province aforesaid and Butting and Bounding to the Northward on Land of Samuel Hamlin James Smith Archer Smith and Daniel Blake to the Eastward and Southward on Land of the said William Norman and to the Westward on Land of Susannah Perry and Sarah Finlay and hath such form and Descriptive Marks as Appear and are Represented in and by a Delineated Plan thereof hereunto annexed and made part of this Indenture

Together with all and singular the houses Outhouses Edifices Buildings Shacks Fences Ways Paths Passages Woods Under Woods Timber and Timber Trees Ponds Lakes Fishings Waters Watercourses Easements Commodities Advantages Emoluments Priviledges [sic] Hereditaments Rights Members and Appurtenances whatsoever to or upon the said plantation or tract of Land Standing being belonging or in any wise incident or appertaining or occupied reputed taken or known used held Occupied Possessed or Enjoyed as part parcel or Member of the same and the Reversion and Reversions Remainder and Remainders Yearly and other Rents Issues and Profits thereof and of every part and parcel thereof and also all the Estate Right Title Interest use trust Inheritance Property Benefit Claim and Demand whatsoever in Law and Equity of them the said John Norman and Richard Norman of in to or out of all and singular the aforesaid premises and appurtenances and every part and parcel thereof

Together with all Deeds Evidences and Writings touching or in any wise concerning the said premises and appurtenances only or any part thereof which the said John Norman and Richard Norman or other of them have in their Custody or Possession or which they can come by or procure without Suit or Expense

To have and to hold the said Plantation or Tract of Land and all and singular other than premises herein before mentioned or meant or intended to be hereby Granted and Released with their and every of their Rights Members and appurtenances unto the said William Norman his heirs and assigns to the only proper use benefit and belief of the said William Norman his heirs and Assigns from hence forth forever

And the said John Norman and Richard Norman for themselves their and each of their heirs Executors & Administrators Do hereby Jointly and Severally Covenant promise Grant and Agree to and with the said William Norman his heirs and Assigns in manner and form following that is to say that they the said John Norman and Richard Norman or one of them at the time of the Sealing and Delivery of these presents is true Lawfull [sic: Lawful] and Rightfull [sic: Rightful] Owner or Owners of the said Plantation or Tract of Land and all and singular other the premises and appurtenances herein before mentioned or Intended to be hereby Granted and released and every part and parcel thereof and that they have good Rightfull power and Lawfull Authority in their or one of their rights to Grant Bargain Sell and Convey the same and every part and parcel thereof unto the said William Norman his heirs and assigns for ever [sic] in manner and form aforesaid

And Also that he the said William Norman his heirs and assigns and every of them shall or Lawfully may from time to time and at all times hereafter Peaceably and Quietly enter into have hold use occupy Possess and Enjoy the said Plantation or Tract of Land and all and singular other the premises and appurtenances herein before mentioned and every part thereof without the Lawfull Let Suit Trouble Denial Eviction Ejection or Interruption whatsoever by them the said John Norman and Richard Norman or either of them their or either of their Heirs or Assigns or any other person or persons whomsoever

And Also that the said Plantation or Tract of Land and all and singular other the premises and appurtenances and every part and parcel thereof at the time of the Sealing and Delivery of these presents are free and clear and freely and clearly Acquitted Exonerated and Discharged or otherwise well and Sufficiently Saved and kept harmless Indemnified of from and against all and all manner of former and other Gifts Grants Bargains Sales Mortgages Dowers uses Statutes Trusts Recognizances Judgments Executions Rents and Arrearages of Rent the Quit Rent hereafter to grow Due and Payable therefore unto his Majesty his heirs and Successors only Excepted And of and from all other Charges and Incumbrances whatsoever had made done committed or willingly or willingly suffered or Permitted by them the said John Norman and Richard Norman or either of them or any other person or persons whomsoever

And Also that the said John Norman and Richard Norman & their heirs and all and every other person and persons whomsoever claiming or to claim any Estate Right Title or Interest of in or to the said hereby Granted Premises and appurtenances or any part thereof by from or under them either or any of them shall and will from time to time and at all times hereafter upon the Reasonable Request and at the proper Cash and Charges of the said William Norman his heirs or Assigns make Do and execute or Cause or Procure to made done and executed all and every such further and other Lawfull and reasonable act and acts Thing and Things Devices & Conveyances and Assurances whatsoever for further better and more perfect Granting Conveying and Assuring all and singular the aforesaid premises and appurtenances and every part and parcel thereof unto the said William Norman his heirs and Assigns for ever [sic] as by him or them or his or their counsel Learned in the Law shall be reasonably divided Devised or acquired

And Lastly that they the said John Norman and Richard Norman and each of them and their and each of their heirs the said Plantation or Tract of Land and all and singular other the premises and appurtenances herein before mentioned or meant or intended to be hereby Granted and Released and every part and parcel thereof unto the said William Norman his heirs and assigns in manner and form aforesaid against them the said John Norman and Richard Norman and each of them and their and each of their Heirs and all and every other person and persons whomsoever shall and will warrant and for ever [sic] Defend by these presents

In Witness whereof the said Parties to these presents have hereunto Interchangeably set their hands and Seals the Day and Year first above Written.

Appeared Josiah Smith Junr who made Oath that he saw John Norman and Richard Norman sign seal and as their act and deed deliver the written Instrument of Writing for the uses therein mentioned that he saw George Smith Junr subscribe his Name as a Witness with himself thereto and that the name Subscribed Josiah Smith Junr is his the Deponents proper hand Writing. ~~~ Josiah Smith Junr
