Will of Isaac Dubose, St. Stephen's Parish, Craven Co., SC, 10 Mar 1773

In the name of God Amen

I Isaac Dubose of St Stephen Parish in Craven County in the Province of South Carolina being of Sound & disposing Mind Memory & Understanding thanks be given to Almighty God for the same do make & declare this to be & contain my last Will & testament in manner & form following

first & Principally I Recommend my immortal Spirit into the hands of my Great Creator trusting in the merit of my ever Blessed Saviour [sic] for Pardon & Remission of all my Sins My Body I Commit to the Earth to be buried at the discretion of my Executors hereinafter named And as to what Temporal Estate it hath pleased God to bestow upon me in this World I Give devise bequeath & dispose of the same as is herein particularly set down mentioned & Expressed

First I order all my just and lawfull [sic] debts to be satisfied & paid

Secondly I Give devise bequeath to my Son Isaac Dubose & to his heirs & Assigns forever One tract or parcell [sic] of Lands wherein my Dwelling house now stands it being the lands I bought from Peter Couturier Containing two hundred & Eighty two [282] Acres more or less situate in St Stephens parish Craven County & province aforesaid

I also Give bequeath & devise to my said Son Isaac & to his heirs and assigns fore ever one other tract or parcell of Lands adjoyning [sic] the above it being the Lands I bought of Jonathan Dubose containing One hundred & Sixty nine [169] Acres be the same more or less

I Give devise & bequeath to my said Son Isaac & to Philip Williams of St Stephens Parish & to their heirs & Assigns for ever [sic] as tenants in common One tract of Land containing four hundred [400] Acres it being all Pine lands situate in St Stephens Parish to be equally divided between them

I Give devise & bequeath to my said Son Isaac & to his heirs & Assigns for ever One Pew in St Stephens Church distinguished & known by the number twenty One [21] situate near the South door of said Church

Item I Give devise & Bequeath to my other two Sons named David Dubose & Samuel Dubose to them & to their heirs & assigns for ever as tenants in Common One parcell or tract of Lands containing five Hundred [500] Acres more or less situate in Santee River Swamp in St Stephens Parish Craven County & Province aforesaid which land was Originally granted to my Self To be equally divided betwixt them by five indifferent Men Freeholders & lives [sic] in St Stephens Parish two to be chosen by each Party concerned & the fifth by them so Chosen

I also Give devise & bequeath unto my said two Sons David & Samuel to them & to their heirs & Assigns for ever as tenants in Common One other tract of land containing five hundred & [fifty one?] Acres more or less situate in St Stephens Parish aforesaid to be equally divided between them as aforesaid it being the lands I bought from John Frierson

I also Give devise & Bequeath to my said two Sons named David & Samuel & to their heirs & Assigns forever as tenants in Common One other tract of Land containing Seventy [70] acres more or less it being the lands I bought of Rene & Samuel Richbourg situate in the parish aforesaid to be equally divided between them as above said

I also Give & devise to my said two Sons named david [sic] & Samuel & to their heirs & Assigns forever a Pew in the parish Church of St Stephen known & distinguished by the number twenty [20] & is situate at the North West Corner of said Church it being the pew I [«unreadable»] of Francis Villepontoux

Further it is my Will in case it should so happen that my Son Isaac should die under Age or before he attains to twenty One Years then & in that Case the aforesaid three parcels of Lands containing in the whole Six hundred & fifty One [651] Acres[1] more or less which I have herein bequeathed to my said Son Isaac shall be equally divided betwixt my said two Sons David & Samuel to them & their heirs & Assigns forever as tenants in Common & it is my further Will that in case it should so happen that either my Sons David or Samuel should die before he attains to the Age of Twenty One Years then & in that Case the part & lotts [sic] of Lands hereby intended to be bequeath [sic] to the one so dying I Give bequeath & devise to the Surviving two Sons to be equally divided between them as above mentioned by indifferent Men to them & to their heirs & Assigns forever as tenants in Common

It is my Will in three years after my decease that my Negro fellow named Sabey & his Wife named Grace shall be free to all intents & intents & [sic] purposes whatsoever & it is my desire of my Children that they will reasonably maintain the two said Negroes named Sabey & Grace from the time they become free [unreadable: presume “until”] their Lives End

Item I Give devise & bequeath to my four children named Joanna Dubose Isaac Dubose David Dubose & Samuel Dubose all the rest & Residue of my Estate to them & their heirs & Assigns for ever to be equally divided amongst them share & share alike My Sons to inherit at the Age of twenty One years & my daughter at the day of Marriage or at the Age of twenty One Years which shall first happen

Lastly I nominate & appoint Mr. Peter Gourdine [sic: Gourdin] of St Johns parish Mr John Gaillard & Mr. David Gaillard both of St Stephens Parish & Mr Theodore Gaillard Junr [Junior] of Charles town to be Executors of this my last Will & testament Revoking & Annulling all other Will or Wills & Testaments heretofore made by me declaing [sic: declaring] the within On one Sheet of Paper to be & contain my last Will & Testament

And now having settled all my temporal Concerns I humbly beseech Almighty God that as he has been graciously pleased to conduct me through all the vicissitudes of this mortal life that he may bring me in his Own Good time to be a partaker of his Endless & unspeakable Glory in his heavenly [____] [____] the Merits & for the Sake of his own dear [________] Son & my ever blessed Saviour & Redeemer Jesus Christ Amen & Amen

In Witness whereof I the aforesaid Isaac Dubose to this my last Will & Testament have hereunto sett [sic] my hand & Seal before the Subscribing Witnesses the tenth day of March in the year of our lord one thousand [not written: seven hundred] & Seventy three [10 Mar 1773]
