Will of Joseph Smith, Colleton County SC, 17 Sep 1738

IN THE NAME OF GOD AMEN I JOSEPH SMITH OF ST PAULS PARISH IN Colleton County & province aforesaid being inform in Body but of sound mind and memory and being mindful of my Mortality do make Ordain and Ratify this my Last will and Testament hereby Revokeing [sic] and disanuling [sic] all former wills and Testaments whatsoever

I give and Bequeath my soul into the hands of Almighty God in Certain hope of resurrection to Eternal Life thro the Merits Christ my only Saviour I Commit my Body to the Earth to be decently Buried at the discretion of my Executors and my Debts and Funeral Charges being first paid I dispose of my Worldly goods as Followeth

Imprimis I give and Bequeath unto my Beloved wife Mary Smith my whole Estate real and personal (after my debts and funeral Charges are paid) Excepting fifty acres of land adjoyning [sic] Mr Samuel Stiles which I dispose of in the following article) To her & her Heirs forever

2dly I Give and Bequeath unto my beloved Nephew John Prentice fifty acres of land on the west side of my Tract of land on which I live & adjoyning that Tract of land on which Mr Samuel Stiles now dwells to him & his Heirs forever

3dly & Lastly I Constitute & appoint my Beloved Wife Mary Smith to be my Exectrix [sic] and my Beloved nephew John Prentice and my Trusty freind [sic] John Stevens to be Executors of this my Last Will & Testament made this Seventeenth day of September Anno Domini One Thousand Seven hundred & Thirty Eight [17 Sep 1738] & in the Twelveth [sic] Year of his Present Majesty's Reign
